Will and Trust Contests/Litigation

Disputes over a deceased loved one's assets are emotional, stressful and need to be resolved efficiently and effectively.

At the law firm of Patterson, Hanna & Associates, our lawyers are committed to resolving estate disputes. We have more than 25 years of experience handling probate and trust litigation for people in Orange County. Our knowledge of the system helps us reach positive resolutions for our clients.

Probate Litigation

Probate litigation occurs when there is a dispute over a will or the management of an estate through the probate process. Common reasons for these disputes include allegations that one person inappropriately influenced the deceased to gain better standing in the will, or allegations that the creator of the will lacked mental capacity at the time the will was drafted. Of course, disputes can also arise when wills are improperly prepared and the language is ambiguous. No matter what the reason for the dispute, our attorneys have the courtroom experience to see that your loved one's final wishes are carried out appropriately.

Trust Litigation

While trust litigation can arise over disputes about the nature of the trust itself, it is more commonly associated with accusations of mismanagement of a trust by the trustee. Sometimes, the violations are clear. A trustee may fail to distribute the assets within the trust, or may simply not administer the trust at all. Or, a trustee may fail to make annual accountings of how the trust has been handled. Whatever the dispute, our lawyers are prepared to go to trial to resolve all types of trust disputes.
