The Probate Process

Probate is the court-supervised process designed to transfer property from the person who died to a beneficiary. The court will appoint a representative, an administrator or an executor to pay off debts, notify creditors and distribute assets to beneficiaries who were either nominated in the person's will or under the laws of intestate succession. Probate provides a very orderly and fair process for the transferring of wealth.

Not All Estates Subject to Probate

Estates with the following qualifications are not subject to probate:

  • Estates that are worth less than $100,000
  • Property passing between spouses
  • Joint tenancy accounts or jointly held property with rights of survivorship passed to the survivor
  • Life insurance proceeds passed to the beneficiary
  • Retirement benefits passed to a beneficiary
  • Property in a trust that is passed to a beneficiary
