What is Domestic Violence?

Domestic violence is abuse perpetrated against a spouse, a former spouse, a family member, a roommate or previous roommate or the other parent of an abused child. Abuse is defined as when one person intentionally or recklessly causes or attempts to cause physical or emotional harm to another or cause one to fear harm to themselves or another. A victim of domestic violence may be entitled to a Protective Order. A Protective Order is a court order issued by the court to protect you from further abuse. A Protective Order will prohibit a party from striking, stalking, threatening, harassing or contacting the victim either directly or indirectly, defined a "stay away" distance or excuse an abusing party from a family residence.

Victims of Domestic Violence

If you have been the victim of domestic violence, you need an Emergency Protective Order and you need it quickly. It is important to note that violent contact does not have to be physical. If you feel threatened, even if you have not been touched, you may still be able to seek protection under the law. Domestic violence cases are always treated like emergencies by our lawyers. Typically, the police that are first on the scene will issue the Emergency Protective Order, but that order is only good for 72 hours. We can go to court with you to obtain a Restraining Order that can provide you with more permanent protection.

Domestic Violence Defense

The Restraining Order laws may be misused in order to gain an advantage in other family law areas. False accusations of domestic violence can have significant repercussions on child custody, visitation and support. It also creates a permanent and public record that could jeopardize your job and future employment opportunities. If you have been wrongfully accused of domestic violence, you need experienced lawyers to help clear your name. Our lawyers can provide the guidance and representation that you need.
